The Agricultural Worker Project (AWP) of Southern Minnesota Regional Legal Services (SMRLS) provides free civil legal aid to eligible agricultural workers in any county in Minnesota or North Dakota. The AWP focuses its work on improving the working and living conditions of agricultural workers in Minnesota and North Dakota through legal representation and education. Agricultural issues generally include: • Field work, including picking rocks, harvesting, planting. • Nursery/greenhouse work. • Livestock work (with dairy, poultry, hogs, etc.). •Cannery work. • Forestry work, including under the H-2B visa. • Beekeeping. • Work under an H-2A visa (permit to perform temporary agricultural work). Cases normally handled by AWP include: • Unpaid wages (late/nonpayment of wages, overtime issues, unlawful deductions, etc.). • Health and Safety concerns (workplace injuries, lack of access to bathrooms or water, dangerous working conditions or machinery/equipment, pesticide exposure, abusive supervisors, etc.). • Unlawful discrimination or retaliation (discriminatory termination, retaliation for getting injured at work or complaining about working conditions, sexual harassment). • Issues with contracts and recruitment. • Various housing concerns related to employer-provided or employer-connected housing. Public Benefits: • Unemployment insurance benefit concerns/denials. • Problems with emergency assistance or expedited food stamps.
